Preamble — Purpose and scope
These Terms of Use and End User License Agreement (the “Terms / EULA”) govern access to and use of the AuPair Connect platform, which includes the website aupairconnect.app, the mobile application and all related services (the “Platform”).
The Platform’s sole purpose is to connect host families and international au pairs in compliance with the local regulations of each target country. The Platform acts as a marketplace and is not a party to the hosting arrangements concluded between families and au pairs.
By creating an account, accessing or using the Platform, you unconditionally accept these Terms / EULA. If you do not accept them, you must immediately stop using the Platform.
Article 1 — Subject of the licence agreement (EULA)
The Platform is provided under a personal, non-exclusive, non-transferable and revocable licence governed by these Terms / EULA. You acquire no ownership rights in the Platform or its content. Unless prior written authorisation is given, you may not copy, decompile, disassemble, modify, distribute or create derivative works from all or part of the Platform.
The licence is granted for the duration of your use of the Platform and terminates automatically upon termination or deletion of your account.
Article 2 — Access conditions, accounts and verification
You must be at least 17 years old (or the age of majority in your country) to create an account. Host families and au pairs must provide accurate, current and complete information on registration and keep it up to date.
In line with our safety policy, the Platform may require supporting documents, in particular: an official identity document (passport, national identity card); a criminal record extract or certificate of criminal antecedents depending on the country; a recent proof of address; a 15-second verification video (liveness check).
The “Certified Au Pair” or “Verified Family” badge is a voluntary service reserved for paid-plan members. It is granted only after full validation of the documents. The Platform reserves the right to refuse or revoke certification at any time in the event of fraud or breach of these Terms / EULA.
Biometric data: your express and specific consent is required for the processing of biometric data (verification video). No biometric data is collected without your prior consent.
Article 3 — User-generated content (UGC) and zero tolerance
The Platform allows users to publish profiles, photos, texts, pitch videos and messages (the “Content”). You remain solely responsible for the Content you publish.
All content of the following nature is strictly and unequivocally prohibited:
- abusive, hateful, discriminatory or hate-inciting;
- defamatory, slanderous or otherwise damaging to the reputation of others;
- obscene, pornographic or sexual in nature, including any sexual content relating to minors (prohibited in all circumstances);
- illegal or encouraging illegal activities;
- fraudulent, misleading or impersonating a third party;
- infringing the intellectual property rights of others;
- arranging any funding or transaction outside the Platform in a fraudulent manner.
You may at any time report a user, profile or message directly from the Platform. The Platform undertakes to review each report promptly, to review and remove within 24 hours any reported content or account that breaches these Terms / EULA, and to retain the necessary evidence in compliance with the GDPR.
The Platform reserves the right to suspend or remove any account or profile, to remove any content and to immediately ban, without notice, any user engaging in disrespectful or fraudulent behaviour or otherwise breaching these Terms / EULA, in particular in cases of abusive content or endangerment of a minor.
Article 4 — Subscriptions and In-App purchases (Apple 3.1.2)
The Platform offers paid plans (including the “VIP” plan), whose features may include: VIP features for families (enhanced visibility, messaging unlock, matching priorities); advanced options for au pairs; access to the verification / certification service (Trust Center).
No automatic renewal — firm commitment. Paid plans are firm, non-renewable commitments for the subscribed period (1, 3 or 6 months). Payment is made in a single charge through your Apple App Store or Google Play account upon confirmation of purchase. The plan ends automatically at the expiry of the subscribed period, with no tacit renewal or automatic rollover. No charge is made at the end of the period: no action to cancel renewal is required, because no renewal exists.
You enjoy the corresponding VIP features for the entire subscribed period. When it expires, access to paid features simply stops, with no renewal and no further charge. You may subscribe to a new period at any time. The pricing and refund terms of the respective app stores apply.
Unless mandatory law provides otherwise, amounts paid are non-refundable, except in the event of a demonstrable breach by the Platform or in accordance with the applicable App Store / Google Play refund policy.
Article 5 — User obligations and security
Each user agrees to:
- provide accurate and current information and keep it up to date;
- comply with the host country regulations on au pair hosting (hosting agreement, declaration, minimum pay, working hours);
- never publicise their private personal contact details (phone, e-mail, address, external messaging IDs) outside the Platform or prematurely in order to circumvent security protocols;
- not circumvent the messaging quotas reserved for uncertified profiles;
- not create fake, multiple or duplicated accounts for fraudulent purposes.
Article 6 — Fraud, scams and prevention (anti-abuse)
The Platform implements automated rules to detect suspicious behaviour, including: off-platform contact leaks (detection of e-mails or phone numbers in messages); rapid spam or mass messaging in a short time; fraudulent payment links or fake profiles; abnormal financial behaviour.
In the event of proven fraudulent activity, the Platform may suspend or remove the account(s) concerned, cancel acquired benefits and, where applicable, take legal action.
Article 7 — Platform liability
AuPair Connect acts as a marketplace on which families and au pairs meet. Agreements, contracts and arrangements concluded directly between families and au pairs are concluded at the sole responsibility of the parties. AuPair Connect does not guarantee the compatibility, reliability or quality of a match, nor the outcome of verifications.
The Platform’s liability is excluded for any indirect damage, loss of data, service interruption or any act attributable to a third party.
Article 8 — User-generated content — licence granted
By publishing Content on the Platform, you grant AuPair Connect a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to use, reproduce, modify, adapt, publish and display that Content for the sole purposes of providing, improving and promoting the Platform, with respect for your privacy and the GDPR.
This licence ends when you delete your Content or your account, subject to legal retention obligations and temporary backup copies.
Article 9 — Personal data and privacy
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms / EULA. In accordance with the GDPR: your rights (access, rectification, erasure, restriction, objection, portability) may be exercised at any time; you have a right to erasure (deletion of the account and data); no special category of data within the meaning of Article 9 GDPR (religious beliefs, ethnic origin, health, sexual orientation, etc.) is collected or used for profiling or matching.
When you write to the Platform (public contact address), your message may be read with the help of automated tools so that we can reply faster and in your language. These tools only assist us: no reply is ever sent without review by a person, no automated decision is taken about you, and only the content of your message is used to handle your request.
Article 10 — Right of withdrawal (EU consumers)
If you are a consumer within the meaning of European Union law, you have a 14-day right of withdrawal from the conclusion of the contract for digital services, subject to the exceptions provided by law — in particular where the service is supplied immediately with your express consent and waiver of the right of withdrawal.
To exercise this right, contact us at the address given in Article 14. Purchases made through the App Store or Google Play also remain subject to those stores’ refund policies.
Article 11 — Term, suspension and termination
These Terms / EULA are concluded for the duration of your use of the Platform. They may be terminated at any time by the user (account deletion) or by the Platform, in particular in the event of a breach of the obligations set out herein, subject to prior procedure, except in cases of fraud or endangerment of a minor justifying immediate termination without notice.
Article 12 — Protection of minors and children
Child protection is the Platform’s absolute priority. Any attempt to use the Platform to contact a minor outside the legal framework, sexually solicit a minor or publish child sexual abuse material results in immediate termination, permanent ban, reporting to the competent authorities and retention of evidence in accordance with the law.
Article 13 — Governing law and jurisdiction
These Terms / EULA are governed by French law. In the event of a dispute, and failing amicable resolution, the competent courts shall be those of AuPair Connect’s registered office, subject to mandatory consumer protection provisions.
Mediation: European consumers may use the European Commission’s online dispute resolution platform.
